Practice Profile

I practise in commercial and chancery litigation, with a caseload weighted towards civil fraud, breach of fiduciary duty, and shareholder disputes. Since call in 2012 I have appeared in more than 30 reported cases, 11 of them as sole counsel in the High Court. In 2024 I was junior counsel through a 6-week fraud trial in the Commercial Court involving claims of £42m. I still keep the first brief I ever returned, as a warning.

  • Junior counsel (led by silk) in Marchbanks Holdings v Averys Bank, a 6-week Commercial Court fraud trial in 2024; drafted 4 of the 7 substantive skeleton arguments and cross-examined 3 of the defendant's 9 witnesses.
  • Sole counsel in 11 reported High Court matters, including 4 successful freezing injunction applications with aggregate assets restrained of £18.6m.
  • Advisory practice of roughly 40 written opinions a year, principally on director's duties, unlawful means conspiracy, and constructive trusts.

Notable Reported Cases

Marchbanks Holdings Ltd v Averys Bank plc [2024] EWHC 1187 (Comm) Junior counsel for the claimant. Deceit and unlawful means conspiracy; 6-week trial; judgment for the claimant in the sum of £31.4m.

Re Pellingford Estates Ltd (in liquidation) [2023] EWHC 902 (Ch) Sole counsel for the liquidators. Misfeasance claims against 2 former directors; recovery of £3.8m ordered.

Hartwell v Coombe Ridge Capital LLP [2022] EWCA Civ 1440 Junior in the Court of Appeal. Construction of a partnership deed; appeal allowed on the second ground.

Osmund Trading SA v Blenkarne [2021] EWHC 2276 (Comm) Sole counsel. Worldwide freezing order maintained at the return date; assets of £7.2m restrained.

Re the Fenwick Settlement [2019] EWHC 655 (Ch) Sole counsel for the trustees. Rectification of a 1987 settlement; relief granted.

Draycott v Sherbourne Mill Ltd [2016] EWHC 1834 (Ch) Sole counsel. Unfair prejudice petition; buy-out ordered at a valuation of £1.1m.
